Right to Redemption after Judical Foreclosure
Complicated situation in Washington State. I lost my condo to a judicial foreclosure in 2015 by falling behind in my condo dues. I was given a 12 month redemption period in which I tried to exercise but the HOA evicted me from the property and when I set up a Short Sale with my lender they would not let me access the property. Does that mean my redemption rights were violated? In the meantime the HOA rented out the property and collected rent for almost three years. In the meantime my mortgage lender was not being paid and decided to finally foreclose this month also a judicial foreclosure. Does the mortgage lien wipe out the HOA title from the previous foreclosure?? The Sheriff Sale notes I have 8 months to Redeem the Property which I want to pursue. I received notification that the mortgage company purchased the property for less than the judgment amount. I received mail from the court station I can set a hearing with in 20 days. I want to access the property to exercise my right to redeem but I am not getting any assistance from the HOA what should I do to exercise my rights to redeem. Would to love to hear opinions and adivice to this timely matter.
