Timeline conflict for accepting disclosure

Chris Lee
Posted

What is there is a conflict in the disclosure and acceptance timeline? What if buyer has original 17 days to accept the seller's disclosure got override to 0 days. And seller doesn't send the disclosures after day 1. Then it is impossible for buyer to actually accept all the disclosures because there are no disclosures to accept. Would that be considered as buyer waving the right to accept the disclosures or this just doesn't apply.

Also would the civil code of buyer has 3 days(5 days) to cancel after receiving disclosures still valid?

@Chris Lee

These are all great questions for your agent. Did you use an agent in this transaction? Paragraph 14.B.(3) of the California Residential Purchase Agreement would govern this issue.

Obviously, I’m not an attorney or your agent.
