Can Resident Manager delay move-in?
We are on track to close escrow on a condo in mid-January in San Francisco. Reached out to the HOA Resident Manager to schedule a move-in, which require a minimum 3 day (preferred 5 day) notice according to our copy of the House Rules from the disclosures. However, the Resident Manager replied with the following:
1) House rules requires an orientation for new homeowners.
2) Orientation scheduling cannot be done until we are legal homeowners, i.e. after escrow has closed. Keep in mind the Resident Manager only works on weekdays during business hours.
3) Move-in's cannot be scheduled until orientation has been completed, and the 3-5 day notice still applies.
This means that this can easily be 1-2 weeks after closing until we can actually move into our condo, which is ridiculous. On top of that, we can't actually locate rules #1 and #2 on the CC&Rs and House Rules, and for #3 there was no mention of an orientation requirement, only that the Resident Manager be given a 3-5 day notice. Also, the Resident Manager isn't willing to give us the CC&Rs and House Rules because we aren't actually homeowners yet, so we have to ask the current seller to provide us with the latest versions to verify. The version we saw from disclosures is from late 2018, so there might not even be a newer version.
Assuming that the latest version doesn't have these clauses which the Resident Manager is claiming, what is our recourse? We don't want to stir **** up on the first day but this is ridiculous.
