California Late Fee and 3 Day Notice

How does the California rule that you can't put late fees on the 3 day notice work? How do I collect late fees? If I serve the 3 day notice without late fees and they never pay on time then there is never going to pay on time or pay late fees.

 Is the only option filing for eviction and incurring the eviction fees? Are the eviction costs about $700.00 (filing, attorney fees) recoverable before the rent is considered paid?

I'm in Inglewood California so Inglewood courthouse.
