Scottsdale homeowner struggles to remove Airbnb listing posted by evicted renter

SCOTTSDALE (3TV/CBS 5) - Before they were evicted, the tenants at a three-bedroom home in Scottsdale trashed the place. “They damaged the carpet. They broke the sink. They damaged the oven,” said property manager Tom Rizen. But that’s not the worst part. The former tenants also listed one of the rooms on Airbnb without permission.

The Airbnb listing promises a guest suite with access to a pool and spa and a private patio to grill and ‘dine under the stars.’ “In Scottsdale, Arizona, what more could you ask for?” Rizen said.

Here’s the problem: the tenant didn’t have permission to sublease or rent out any part of the home. “The city of Scottsdale informed us that this posting on Airbnb was up and that it was a violation of the ordinances with the city of Scottsdale, and if not removed, they were going to start fining the owner for it,” Rizen said.

Rizen reached out to the former tenant, who never responded to requests to remove this listing, and 

he says Airbnb refused to help, too.

Seems like a mess. This is why a RA is so important

Rental agreement 

Rental agreements don't really help in a situation like this. It says he was evicted. So, that part was dealt with.

I bought a property in the historic part of Phoenix that was waiting to be rehabbed while I was working on a couple of other properties. The neighbor behind me saw that it was empty & knew the previous owner had moved out.

He broke in, installed new locks in the front and back, had the utilities changed into his name, brought in some cheap garage sale furniture and listed on AirBNB. This was all in a matter of a few days.

I came to check on the property and there was a strange truck in the driveway and the locks had been changed. I couldn't get in. I called the police who came over about the time that the STR renters arrived back from lunch. They had a key to get in that the "guy behind my house" gave them. It took some ‘splainin from them, but I figured they'd been snookered and I told the police they could go. The STR renters were as confused as I was.

AirBNB wouldn’t talk to me. I didn’t have an account, I didn’t set up the account, I didn’t book the property.

Fortunately the STR renters filed a complaint with AirBNB and eventually AirBNB removed the listing. But I couldn’t do a thing other than change the locks.

The neighbor got away scot free. The police said it was a “civil matter” They said I had no way to prove he was the one who broke in and apparently it isn’t illegal for him to change utility bills into his name. (That doesn’t sound right to me but they wouldn’t book him).

I guess the moral of the story is you have to have someone book the property, claim the property is unsafe, unhealthy or a scam or whatever, and then that person complains to AirBNB and demands their money be refunded. That might get it delisted.
