POA Attempting to limit STR

Robert Pettigrew
Posted

I’ve got a very atypical situation with an investment property in Watauga County North Carolina.

I purchased my property in 2019.  The development was built in 1984.  No restrictions regarding short term rentals.  There was no property owners association when I purchased.  The original restrictions make way for one in order to maintain road, see attachment.

Soon after I buy the other owners start pushing for formally establishing the POA, again, the development has been around since 1984 without forming one. This should have been a red flag for me.

So they draw up by-laws and hold 1st meeting and it’s proposed they change restrictions to ban short term rentals.  They hold a vote and 7 of 10 owners vote to adopt restriction.

Just curious if anyone has experience fighting something like this. It seems I should at least be grandfathered in given there was no POA and no restriction when I purchased. Also of note, there are no common areas, just a shared road.
