"Short-term rental owners will soon be required to register their properties with the city to stay in business in Scottsdale.

Armed with a recently enacted state law, Council unanimously amended the city’s vacation rental code to require owners to obtain a $250 local license annually beginning Jan. 8.

They will have to register their name, address, phone number and email address for the owner or owner’s agent, the rental’s address and proof of compliance with transaction privilege tax license requirements.

“We’ve all spent many years listening to complaints and I just want to say it was incredibly refreshing and relieving to finally be able to say, ‘Okay, now we can do something,’” Councilwoman Tammy Caputi said.

“People would call us and complain and all we could ever say was, ‘We can’t do anything. The state won’t let us do anything.’ It was incredibly frustrating. So I just want to applaud us because the minute the state allowed us to actually make an ordinance and help solve some of these problems, we did it immediately.”

Councilwoman Linda Milhaven reassured the short-term rental industry that the city will continue to refine the amendment."

New Rules:

The code requires vacation rental owners to adhere to a list of regulations, including:

Non-residential uses of a short-term rental are prohibited.

An emergency contact must respond to requests from public safety officials within one hour.

The owner must have liability insurance.

Owners must conduct background checks within 24 hrs of a stay to insure the person booking the rental is not a registered sex offender.

Owners must notify inform adjacent single-family homeowners or units on the same building floor in a multi-family setting that they are operating a short-term rental within 30 days after receiving a license.

Rentals must include smoke detectors and an exit map.

Short-term owners/operators must not leave trash/garbage in public view unless properly in collection containers, and must ensure that trash/recycling collection containers are properly placed and removed per collection schedules.

The rental must be cleaned after each stay.

Pest control must be conducted at least bi-monthly.

Four-foot barriers must be up around pools and hot tubs with gate. Homes can also serve as a barrier but the doors and windows must be outfitted with alarms. This must be done by May 23.

A notice about laws governing short-term rentals and property information must be in the home.

The city estimates that as of September, there are at least 4,300 short-term rentals in Scottsdale AZ, according to Scottsdale Assistant City Manager Brent Stockwell.
