Absentee Landlord Legal Issues
I currently live in California, I'm a licensed Broker in California, but not currently practicing real estate. I own 3 properties in Colorado that have been managed for over 20 years by someone who recently passed. The individual who has worked for the previous "Property Manager" as his leasing agent and maintenance contact has offered to continue managing my properties. He does not have a license.
It would help to maintain continuity with the existing tenants, one of which has been in the property for over 20 years if I kept him as my local "Maintenance Coordinator". I use that term because I'm fully aware of the license requirement for a Property Manager.
As a Maintenance Coordinator the individual would be responsible for coordinating any work to be performed. Receiving Rental Checks and forwarding them to me. Basically the local contact person. He would not handle any Cash only forward checks made out to me. He would not "Lease" a unit, I would handle that remotely. He would handle making the keys available to a tenant if there is a tenant change.
This may not meet the spirit of the license requirements, but should meet the letter.
What's other people's opinion of this idea? Would it be legal? Risks for me as owner and Him as "Maintenance Coordinator"
