Eviction Moratorium and Lease Ending

Can anyone confirm my understanding of the eviction moratorium? I have a tenant lease ending 8/31 and scheduled to close on the sale of the home 9/3. The tenant notified me today that they need more time because 3 members of the home have COVID. They are section 8 tenants who have ended their voucher effective 8/31 also. I don't believe the moratorium precludes me from filing eviction based on the lease ending. Thoughts?

Your state may have specific requirements on evictions separate from the national moratorium. In my area, we can file an eviction based on lease ending and tenant not leaving IF they were given proper notice and didn't leave. I would imagine most areas are probably the same. Before you try filing for an eviction, you'll want to make sure the previous owner followed all of the set protocol for giving non renewal notices. If they did not, you may have to issue your own notice and wait the specified time frame before you are able to start eviction proceedings.
