Social Service check went to prior owner!

I just bought a house last month, but my management company didn't submit paperwork for change of ownership to DSS (Government Assisted Tenant) until the first of the month. Apparently the check already went out to the old owner. Is there anyway I can persuade or even sue the old owner if he does not kindly send it to me?
