Quick legal way to handle illegal lockout in Massachusetts.
My son's girlfriend who lives in Massachusetts was told on Friday by her landlord she had a week to get out. She is probably a 1-2 months behind on rent. She has NOT been evicted or given notice to quit officially but came home that same day to find the landlord had changed the locks on her apartment. It sounds like he padlocked the door. All her stuff is in the apartment. I told her to call legal aid that this is an illegal eviction but it is the weekend and I am wondering what are her options to legally gain access to the unit. The situation is complicated because I am pretty sure this is an illegal unit and it is likely in significant disrepair just judging by the steps to the second floor. And frankly this landlord is a jerk because she was likely going as requested. Can she just cut off the padlock or will that become a legal issue for her?

Since it is obviously an illegal lock out, I’d have no issues simply cutting/changing the lock. Maybe take some pictures and send an email/text advising the landlord that she knows it’s illegal and will pursue it accordingly. Form what I hear Massachusetts laws are tenant friendly.
