Tenant won’t pay rent eviction process

We have a tenant sitting and not paying rent. Him and his girlfriend signed on together with two kids. Their lease expired last year. Month to month basis. Broke up in April 2021 she moves out but keeps her stuff I. The basement that they are renting. And finds a different place. He won’t move out. Used security deposit for May and now we are in June and won’t pay rent. We have an attorney going to court next week for non payment of rent. He won’t file for assistance, won’t provide any details of employment for me to file so my application has been rejected by the rental assistance company. He won’t communicate his plans. Doesn’t go to work gave an excuse hours have been effected but won’t file for assistance for rent. I really hope we win a judgement against such a lazy person who refuses to do the right thing. He has a habit of leaching off people from what his supposedly ex gf told me but she is also leaching off us by storing all her stuff in the basement. 
I am hoping the judge sees right through them and grants an eviction. Because they haven’t followed any of the CDC rules to qualify for the eviction ban. 
this is in loudoun county Virginia. I am hoping someone else has been successful in a similar case to mine?
