Terminating a Month to Month Lease in Texas

Ken Dunn
Posted

I have a tenant that just completed a one year lease and is now month to month effective June 1st, 2021.

I know I can give a 30 Day Notice of Non-Renewal to end the lease.

My question is, can I give the notice on June 8th stating the lease expires on July 9th (one day after 30 days)...or do I need to wait until the end of June to give notice that lease will end on Aug 1st?

If tenant does not vacate by July 9th, I plan to give 3-Day Notice to Vacate on July 10th and start eviction process.

Your input is greatly appreciated.

Ken

Best to give them 30 days notice.  If lease expires on July 1st, on June 1st give them 30 day notice telling them you will not re renewing the lease.  Have to give them time to find a new place and go through the moving process.
