Is it legal to claim my wife as a tenant ?

My wife and I are closing on our townhouse on June 3rd. I was wondering since she is not on the loan but will be on the title. My question is can I claim her as a tenant that I am renting half of the house to? Then I get a tax credit at the end of the year, depreciation, etc....

would that be legal ? An investor brought it to my attention.
