Buying a 2-unit both tenant occupied, need one for me.
Hello BP Community,
I'm about to become a first time home owner in San Diego City. It is a 2-unit property, both are tenant occupied. I want to occupy one of them as my primary residence.
Facts:
- The unit that I want to occupy has the same tenants for past ~3 years
- They are current on all rent, no security deposit
- Lease is month-to-month
- Given where I'm in the process of buying the property, I'd doubt I can ask the seller to have the unit vacated
My research:
- Given they have been here for more than 2 years, I need to give them at-least 60-day notice
- My "just cause" is that the owner wants to reside in the unit. It will be my primary residence
Concerns:
- How should I approach this? On closing the property, should I just have an open discussion with the tenant and give them a 60-day notice? I do not mind if they leave sooner.
- Will an eviction ban due to Covid-19 cause concerns? They are current on rent so my assumption is that they do not have a financial hit due to covid. From my reading, the eviction ban is only in the case the tenant is facing a financial hardship, and my just cause is valid.
- Since this has been their home for few years, I can provide some assistance to them to aid the move. Is this the norm or the ethical thing to do?
