CA Section 8 Lease Expire Notice of not extending

Hi,

I have a section 8 (California) tenant. We signed a yearly lease which is about to expire on March 13th 2021. As per the lease terms the lease will auto convert to month-to-month if a rent is received/accepted or a 30 day notice would be given to not extend the lease.

I gave a 30 day notice but the HACA says that I have to give a 90 day notice for Section 8 tenants. I explained that this is not eviction but simply not extending and continuing the lease.

We want to sell the house asap and this is blocking us.

I have heard conflicting reports that a 60 day notice is needed but HACA says (verbally on phone) that I have to give 90 days notice.

Appreciate your responses based on your experience.
