Evict a tenant on a month-to-month lease
I inherited a tenant who has not paid rent since I bought the duplex in late November. The person has been living here for years and now is on a month-to-month lease. The person is also receiving free access to the garage in exchange for yard care (basically rent credit) but is not catching up with the responsibility either. The property is in Minneapolis MN and there is an eviction moratorium in Minnesota, currently due to end on Jan 13 unless it's extended beyond that. There is the CDC moratorium too as you all know.
The question is: "Can I evict a tenant on a month-to-month lease?"
Let's consider two scenarios:
- Scenario 1, Minnesota eviction moratorium is NOT EXTENDED. How fast can I evict the tenant and what are the steps?
- Scenario 2, Minnesota eviction moratorium is EXTENDED beyond Jan 13. Can I still evict the tenant due to lease expiration and how is the process different?
