Pool heater is broken

We rented a house with a pool heater, but after moving in we realized it was broken, there is nothing on contract that mentions that appliance. But no one told us it was broken. We rented the house because of the pool and the heater since right now the weather is colder and the heater would be a plus for the family safety. I checked the temperature of the pool water and on the surface it’s 62 F, the national center of cold water safety says that we need to be careful with any water temperature below 70 F. PM said they won’t fix it because they did not advertise it, what can we do about it?
