Purchased Property with Tenant Previous Owner does not have lease

I recently purchased a property that already had a tenant. The previous landlord does not have the lease for this tenant. I’ve tried to have the tenant sign a new lease but they refused. The couple is almost a month behind on rent payments. What can I do if the tenant does not sign a lease ?
