Eviction in Colorado

Hi

My friend has a property in Pueblo Colorado.

His tenant has been paying late since the beginning of his lease in March, hasn’t paid October saying he was laid off due to COVID19.

A local attorney said that if My friend starts an eviction procedure, the tenant may claim in court that he is unemployed due to COVID and will be homeless if evicted, in which case the court will allow the tenant to stay.

Does anyone here has an idea or success with evicting a non paying tenant these days? Do you have to claim in court that the eviction is based on another reason rather than payment such as a lease violation?

Any information will be appreciated!
