ESA - Roommates do not want
Is there any basis of denying an ESA beyond being able to prove it is either a damage to the property or others, or an undue financial burden? The only out I can see is that the landlord's insurance could deny it based on the breed (which I do not know yet).
More interesting to this case is that the house has 3 roommates. 2 roommates want nothing to do with having this ESA in the home. Does the ESA's presence violate the other tenants' right to quiet enjoyment of the property? If so, does that give the landlord the right to refuse the ESA?
I don't think it does, but this is a curious situation that has come up and wanted to see what the BP community thinks with similar experiences.
