Eviction | NSF | Late Charges | Breach of Contract

Posted

I have a tenant that paid by check, it bounced.  I've notified the tenant of the contract stipulation indicating that I will no longer take checks and the associated NSF fee as well as late fees.  The tenant is hostile and is continuing to pay the rent with personal check.  No late or NSF fee sent as well as deviating from our agreed lease agreement.  I have posted the 3 day notice to vacate or pay in full.  I plan to proceed with eviction process here in Texas.  I am wondering if anyone has had this experience and what can potentially be expected from the court.

Not sure if the court will see this as breach of contract for refusing to change the method of payment and not paying the agreed NSF and late fees.

Thanks,

RL
