Abandonment/Nonpayment suit against Tenant while in Forebearance
I have a Tenant in Texas (Houston / Harris County) who fully abandoned their property at the beginning of the month. I am thinking about pursuing a non-payment suit against the former Tenant to (possibly) recover what I can. We posted the proper notices and are fully in line with the right practices except for the final step of actually filing suit.
Additionally, the unit that the property is in is a Fannie Mae-backed mortgage on forbearance. So far, I'm not seeing any guidance online on if I can pursue this kind of suit (i.e., nonpayment); there is only guidance on evictions (i.e., you can't do it if you're a Landlord/Owner in forbearance).
I'm wondering if anybody here has heard of any additional clarity on this issue. Or if you can provide advice/suggestions on this nuance.
