Landlord rights to personal property

Raven Sheeler
Posted

I am a landlord and have sold the property. I followed all of the rules and regulations. I told the tenants 2 weeks ago that i would be moving out my personal property tomorrow and i just received an email (not even 12 hours before I'm supposed to go get my couch and table) from one of the tenants parents that they are going to bring me to the tenant board if i take out my furniture. It does state in the lease that it is a furnished apartment, but i would assume it is now the new landlords responsibility to furnish the apartment, or am i wrong? I am not sure what my rights are here and cant find any information online. By the way i live in Ontario Canada. Does anyone have any information?

You are wrong.

You rented a furnished apartment. Your contract transfers with the sale of the property, which means the tenants have the right to continue using the furnishings you included.

You should have sold the furnishings with the home or negotiated an exchange of furnishings with the tenant. It sounds like you didn't talk to the tenants at all and now they're rightfully upset that you're trying to change the terms of the agreement.

Unless this is furniture of sentimental value or significant monetary value, I would let it go. See if you can convince the new owner to purchase it from you with a bill of sale.
