Does anyone think there will be mass class action lawsuits?
Out of 9 rentals, I’ve got a couple of houses where tenants are clearly taking advantage of the current moratorium.
They have decided to pay less than the amount owed even though there is no reason for them to do so, and they have the funds. One of the tenants has over $100k in his account that he saved up to eventually open a restaurant.
As most of you probably know, the current rules (at least here in Nevada) are only written to benefit the tenant; tenants don’t need to show proof of hardship to not lay or get discounted rent. The moratorium shifts the entire burden onto the landlord to carry the tenant. In the absolute worst case, if he decides he doesn’t want to pay anything, you are still required to maintain the property, pay all county taxes, fees, etc.
This law is absolutely unconscionable and in my view is a pure and simple taking.
The unfortunate part is that landlords are easy targets. We don’t have many advocacy groups representing us. We are usually viewed as having deep pockets and the media love, to shine a negative light on us, especially recently.
So my question is, do you believe we would have a standing chance to sue or would it be a long shot?
I’ve seen some lawsuits start to take place but they are few at this time.
