Security deposit still safe after tenants filing a bankruptcy?
To narrow down my previous post question: if the tenants filed bankruptcy during lease term, and they are not paying the rent. Can I evict them during lease term? They put a substantial amount of security deposit at the beginning of the lease. Can I still use the security deposit for the unpaid rent even under the circumstances that they are filing a bankruptcy? In other words, by law, do we have to return their security deposit(they are not paying the rent) because they are bankrupt? I would really appreciate your advice.
