Property Management Received Fine from the County for no Permit

I'm on a HOA in a small condo association. In our HOA by-laws/master deed it requires us to use a property management company.

Over the last year the town requested we replace a retaining wall.

The Property management company hired a contractor to work on the wall and broke ground without a permit. The county fined the property management company $2000. They sent our HOA the bill, should the HOA be responsible for a fine issued to the property management company because they did not to their due diligence before starting the construction?
