Chicago Owner-occupied Eviction process

Alexandra Cory
Posted

Hello All,

My mother owns and occupies a house in Chicago and she is trying to get a lodger out of the house. The lodger has no formal lease, and the lodger was served a 30 day notice to vacate the property over 30 days ago. From my understanding, my mother is not legally obligated to follow formal eviction protocol at this point due to her status as an owner occupant. I also understand that she has the right to ask the sheriff to help remove the tenant. However, the web tells me that sheriffs often are not privy to doing so. I was hoping someone might be able to advise a best course of action for removing the tenant? We want to make sure we are acting legally, and we want the tenant out ASAP.
