Month to Month Tenant

Hi everyone,

I have a tenant who's lease ended back in August, 2012. They have been month to month since then. However, they have just given us verbal notice that they will be leaving at the end of the month. The problem is they won't be paying us for this month's rent because they believe they provided us first and last month's rent when signed the lease a year ago.

As a side note, we bought this apartment in May so this tenant signed a lease with the previous owner, which we have a copy of the original lease. Do we just send them a copy of this lease which indicates the last month's rent was not collected upfront?

The tenant refuses to pay even though we had told him that the original lease did not mention the "last month"s rent. I'm worried they will not leave and not pay for this month's rent. Rent was due on the 1st and considered late today.

Any tips?
