Can an owner move into a fully occupied duplex in Oakland, CA?

Ryan Wagner

In Oakland, CA:

If I were to buy a duplex that was fully occupied, but one of the tenants had a month to month lease, would I have the right to give the tenant notice and move into the unit? This is different than the "cash for keys" ask.  My real estate agent mentioned this but I can't find supporting documentation. Thanks!

hi @Ryan Wagner you can do an owner-occupy eviction, but you must make sure the tenant is not protected class. https://www.oaklandca.gov/reso...
