Deposit to reserve apartment
Applying for rental with the property manager on a Thursday.
After viewing the apartment and filing out the application and giving them $50 non-refundable application fee. A $150 fee was also require to "reserve" the apartment which was being remodeled and would be ready in 7-8 days. At that time were "told" by the property manager, that the $150 fee was refundable. The next day, Friday, we called the property managers office and spoke to the assistant property manager and were told the "deposit" was non-refundable. We then received a letter via email with the breakdown of the monies due upon move in and other information including utility companies and a copy of the application (We were not previously given a copy). On top of the letter it states: "Security deposits are forfeited if reservation is not cancelled in 72 hours." We were not made aware of this; we gave a deposit to reserve the apartment and that is what we thought it was for and were told it was refundable. They also did not make us aware of other fee's, trash and pest control...
We never signed a lease due to the misrepresentation. Such a bad taste....
Is this how it goes? What are the laws on this?
Feeling duped.
