Tenant in Jail?

I have a tenant who is in jail. His lease is up at the end of this month, I've wanted him out since I purchased the building. I've already notified him that his lease would not be renewed and that the move-out inspection was on 4/30/12.

2 questions:

1. The apartment is only supposed to be occupied by him, however I'm aware of many other people who are living there and/or coming and going. Can I change the locks? I do have an email notification set up for when his incarceration status changes.

2. If he's still in jail come 4/30/12, can I just throw all his s**t out and change the locks? I know there are laws around evicting tenants. I just don't want to have to follow an eviction process for somebody who is already out. Not to mention they've given up a lot of their rights by doing something illegal to land them in jail.

Any thoughts??

Michael, consult a qualified lawyer.

You are asking a legal question which if answered incorrectly and you follow that incorrect answer, could expose you to more trouble. Therefore consult a qualified lawyer.

Because you feel that a judge would side with you does not mean that the judge that hears your case will side with you.

You want this undesirable tenant out of your apartment, I'll bet you want him out of your life too. Follow the rules/laws. Ask a lawyer who is familiar with these situations in your state/county/municipality what you must do.
