Q Oregon Landlords and PM's: Violence today cops and now hospital
Today has been an emotional day, and I have a question for probably Oregon property managers or landlords as the laws changed in March regarding wiping out 60 day NO CAUSE evictions. I believe now a tenant must have 3 violations in a 12 month period and need to evict only FOR CAUSE if they have lived there longer than a year.
Today's news: I inherited a tenant a year and half ago that admittedly goes on and off legal meds and acts weirdly. Today, he allegedly hit a tenant over the head and on his arm with his cane so hard the man is in the hospital. The story I am getting is that the man who hit the other tenant was mad about flowers getting planted in a common area. The nearby tenant stuck up for the 83 year old woman who was getting yelled at by cane man. Then cane man came after the man and smacked him several times. The cops show up and the cane man says he was the one assaulted and the other guy grabbed his cane and he was the victim. Of course, there were no marks on him but the other man was beat up a bit. The cane man has been a issue where tenants think he cause trouble, from calling the cops thinking tenants go through his mail, or citing tenants do not like him because he is black. I personally have had issues a year ago where he emailed me like 20 times going crazy on me and stating if a contractor came into his unit, he would shot him. He did admit to the officer that he had a gun and would use it if he needed to and also told the cop that he was in between meds.
With the new Oregon laws, should I cite him, and what about the other tenant as there is no proof? I am at a loss, and these new laws are tougher for me to know. I know I can hire an attorney, but the last time it cost me $4000 to evict and I figured I could ask here to see what Oregon RE knows about this, or any other thoughts around the nation?
