Are these legit security deposit deductions
Looking for some advise on what and how much is realistic to deduct from a renters security deposit for a few items below or am I being nit picky???
I do want to preface this... I inherited the tenant and I didnt do an itemized walk through (but maybe able to get ahold of one from property manager) defining the condition of the property. The tenant I believe has been in the property for atleast 3 years
- Light bulbs missing everywhere
- Door pump bent and coming out of door hinge but works
- Disgusting bathroom - see pictures
- Excessive amount of nail holes, 1/2 filled with toothpaste
- refrigerator not cleaned out
- random things left behind and in the yard, quoits , balls, havent looked yet but probably dog droppings.
- dog scratched at the door and scratched paint off of storm door
- dog marks on back door (see attached pictures)
- stains on rug (makeup i think)
- tenant installed porch light with out permission (see attached picture)

Yes, they are legitimate deductions.
The odds of this tenant fighting you in court is probably less than 1%. Do what you need to do, document it, and send notice to the tenant in accordance with the law. Don't sweat it.
Normally, I would agree with Kim and say that you should be careful about what you charge because you don't have any evidence of the prior condition. However, the scratches on the door are pretty clear if the tenant had a dog large enough to do that. Missing lightbulbs are easy to prove, as is the filthy appliances and bathroom. I don't see anything here that's very questionable. As a PM, I would hit this tenant with every charge I could find, knowing full well that they'll never come after me for it and I would probably win even if they did.
