Running criminal background checks
Can we legally (in TX) run a criminal background check and charge for it, on a adult tenant who is not a co-signer on the lease?

You need to make sure your lease clearly states who the occupant(s) of the rental will be and that any change in occupancy must be approved by you. If he wants to move in later, you can require him to fill out an application at that time. Your lease should also define the difference between a guest and an occupant to make sure he would be defined as an occupant if he moves in.
