Car was damaged by a garage cabinet

Anthony Quiros
Posted

I came home one night and go into my house via the garage and saw that a cabinet mounted on the wall had fallen and damaged my car door. Upon further inspection the cabinet was mounted via 2 drywall thread anchors and not mounted to the studs and the cabinet was remounted before using this technique after seeing previous holes on the drywall. I hardly had anything in it except for construction garbage bags.

Unfortunately, renters insurance won't cover the damages and I would have to use my car insurance but I don't want to pay the deductible. I asked my landlord to pay for the damages or use his insurance but he is refusing to pay for the damages and stated that those cabinets were mounted when he purchased the place. I don't know if he is telling the truth or not about the cabinets being there before or if they were installed after he purchased the place. I highly doubt that the cabinets were on the wall for 6yrs without it falling off before as I saw previous holes on the drywall.

Is he held liable for this? Can I take this to small claims court?  If I can find information about the cabinets being mounted or remounted after he purchased the house will he then be liable?

Thanks
