ADVISE: Tenant using as Office - Hasn’t Paid 5 Years

I’m looking at a potential deal over here in the Washington DC market. The owner has a tenant who is using the property as a dental office but he hasn’t paid in almost 5 years. The owner is fed up and in denial about everything and doesn’t want to deal with the place anymore. I’m wondering, because their rental contract is breached by non-payment, does the owner have to file for eviction or can he just sell with the tenant in the property and we handle kicking the tenant out?
