Tenant refusing access
This is the 2nd tenant I've had this problem with. The lease states that I can enter the property with proper notice (48 hours), as can my contractor, assignees, realtors, etc.
I notified this tenant a week ago that I'll be coming to check the property this week. She had said she might be out of town. Today she texted me that she will indeed be out of town the exact days I'll be in the state. How coincidental :)
I told her that was no problem, that I had a key, and would let myself in. She replied that she is not comfortable with that, and that no disrespect, but it's her home.
It may be her home but it's my property.I went through this with a previous tenant, who went berserk whenever I or my contractor needed access to the property when she wasn't going to be home. She called Legal Aid, who did indeed confirm I had the right of entry with proper notice. However, it made for a very contentious relationship until she moved out a year later.
In this tenant's case, we have a good relationship, she pays the rent on time, and has been easy to deal with. She already told me she'll be moving at the end of the lease in 5 months, as she really can't afford to stay since her roommate left.
I'm not sure if I want deal with another hostile situation by fighting with a tenant over access and having my attorney deal with this. Since I have a key and the right of entry, what's the collective opinion about telling her that I'll be there anyway? Thanks!
