security deposit return dispute

We have a checklist that we give the tenants WELL before they move out of what the charges are if we have to fix things, so upon eviction notice served, I also included our check list.

We did a walk through with the tenant and noticed some serious carpet stains. Now when we entered the unit after the tenant left, she did attempt to clean them however they were still visible. So there was carpet cleaning, some small picture holes that had to be patched a bathtub that wasn't cleaned, and some other misc stuff. We held $188 back from her $625 deposit and sent her the same checklist we did during the eviction and circled the things we had to fix.

She of course is disputing it. She said that she would split the difference with me and wants $94 back.

Am I legally ok to say no?
