Failure to get deposits

We are about to put an offer on a 2 family. What we have found out is the owners did not get a deposit on leases that are at about the halfway point. Instead they got last months rent upfront. Is there really a differentiation between these two? And more importantly, any way we can obtain deposits from the tenants at the point if the purchase come to fruition?
