Section 8 and Tenants paying for Pest and HOA Fee
Hello, my wife and I recently became Landlords and went through the Section 8 process and have a Section 8 Tenant living in our Townhouse. When we were originally looking for renters, the Section 8 Tenant approached us and convinced us to go through the process. We were asking $1100, but HUD would only allow up to $1028 for rent. However, in order to make it meet at $1100, we put in the lease that the Tenant is responsible for paying the $30 a month for Pest service that we provide and our Home Owners Association Fee of $45 per month. Which puts us at the $1100 we originally wanted, as if we had tenants paying $1100 rent, we were still going out of pocket to pay the Pest service and our HOA Fee. Now when we went through the process we wrote on the HUD/Section 8 paper work under utilities section in other we put Pest and HOA Provided by Owner, Paid by Tenant. This Lease and paperwork all went to Section 8, no side deals, nothing hidden. However, I'm curious to know if were still in some kind of violation of the HUD program, as our Tenant's rent is paid 100% by HUD and they even kick her $72 for utilities, but are we in violation requiring her to pay the Pest and HOA fee? Like I said, it was clearly in the Lease presented to Section 8/HUD.
