Previous tenants moved back in without permission & won't leave
I'm an agent with a short sale. My client, the owner can no longer keep up with the mortgage payments since her tenants who were renting the detached converted garage stopped making payments. They are also refusing to leave. The tenants agreed & signed the 60 day notice to vacate after they are notified that the house is in the process of foreclosure. Just when we were about to close escrow, the house was finally cleaned out & vacated. However, the tenants moved back a day later, breaking the locks on the property. The owner called the police, but they didn't do anything. The police advised the owner to get an eviction lawyer. So she did. I understand that it's a process with the courts & it could take a few months, but in the meanwhile, the tenants has turned the utilities back on under their names. Furthermore, they now have their parents occupying the rest of the property. The lawyer said, we can't do anything about it until we get a court order. I'm afraid they will destroy the property. Is there anything I can do to help my client in the meanwhile? This is a nightmare.
