How do I evict a family member/non paying roommate from my house that I own and live at in California with oral rental agreement that she would move out by the time her son got out of the mental health place which he is out now

do I give her a 3 day notice or a 30 day notice ?Would she be considered  month to month tenant ? And how would I

Serve Eviction Notice cents we live at the same address ?

the reason is because she is not paying and or month to month doesn't need a reason you just want possession

A good friend of mine is a top notch California real estate lawyer who does evictions (among other real estate law cases).  Her name is Jennifer Felten and her company's site is www.relawapc.com and is based in Westlake Village (Ventura County).  If she can't help you, she may be able to refer you to someone who can.

I recommend only using a lawyer for evictions, since the laws can be tricky and self-help websites may not be 100% accurate or up to date (and much harder to ask questions of).  I also recommend using care, since this person is living with you.

Google CA landlord tenant laws..

In my state your required to give written notice, and if she is still there after 30 days you have to go to housing court and file eviction action. Verbal or written agreement to rent, / stay.

Eviction action would be just for her at your address, yes.. so give her written notice you will file for eviction if she has not vacated prior to end of the 30 day time period.

Or you could offer her cash to get out. If you do that you get her to sign agreement she will vacate in like 3-4 days, you will pay her cash of $$ and have her sign it. then once she has her stuff out the door pay her,, and change the locks,, and do a "No Trespass order"
