month to month tenant questions

Hi I purchased a property. The previous owner said that the tenants were month to month with no leases. This is my first experience with m2m. One of the tenants is already late. Normally in a lease you have everything written out such as after three business days, there is a $40 fee etc. Since there is nothing signed, what protocol should be followed? Is this a mistake on my part in which I should come up with a special month to month lease so that everything is specified? Are there county default laws if there is no lease such as late is after this amount of time etc...  If I need to go through the eviction process, how can the eviction process even begin if there was no lease in the first place?
