When to evict - late payment

Hey guys, just curious in the state of New York how long you go waiting for rent before you serve an eviction notice. I have a tenant I can't reach and they have been 3 weeks late on rent... I imagine it's going to continue. Just was curious what guidelines people follow. Thanks in advance.

In New York, before you could start a non-payment case, you need to give a written three-day demand for overdue rent. This informs them that they have 3 days to pay or you can file a court petition for an eviction. 

The notice of eviction has to be given to the tenant by a sherriff or marshall.
