Harassment by neighbor

Hi, I have owned a condo in Winter Park for 1.5 years now. From the beginning the owner below me complained about me and about my tenants. Last year, my ceiling fan in the bedroom kept her awake and she complained for months. She will call me and email me or go directly to the tenant's door and harass them at all hours. I had an attorney write her a very expensive letter wherein he told her which Colorado laws she was violating and that if she continued her tirade, he would sue her. She has been semi-quiet for a year but now I have a 6-month tenant, and she has begun to harass this tenant. She appeared at the door during the tenant's dinner date and demanded that she come outside to view/discuss the garden area. She was drinking, staggering and slurring during this event. She has lived in the complex for 25 years and is a known hazard by the other owners. Other owners have informed me of her past charades and some were worse that what she has shown me. Last year, I asked the HOA for help but they said the issues were between her and I. Unfortunately, In September 2016 this owner nominated herself as HOA president and was voted in. I realize I may need to involve my attorney again, but a few calls with him is equal to the monthly rental income.

My questions are: 1) Does the HOA have any responsibility with the owner/now HOA president who harasses the tenants in the complex? 2) Does it make sense to file a lawsuit against her and what is the amount of damages to seek? Loss of income, loss of appreciation due to a possible sale during a rising market? 3) Do you believe it is best to just cut my losses and sell my unit and remove myself from this agonizing conflict? 4) What can I do to soothe a harassed tenant?

Welcome to the wonderful world of condo HOAs. This person IS the stereotypical condo HOA board member and the #1 reason why I think condos are one of the worst investments; right behind mobile homes in senior parks.

Sell and move on. There are so many better opportunities out there.
