Tenant Never Moved in

Late last month a lady and he husband signed the lease, paid deposit and first month rent.  about a week later, while we were on vacation, she called and said she would not be moving in because of a family illness.  We had several prospective tenants at the time,  when we came home from vacation we relisted the property.  What do I legally have to return?  I have a 30 day notice to move out in the lease.  took a total of 14 days to re-rent the property.

When I accept a deposit it is non-refundable and that is made clear in writing.

Since you were able to re-rent in less than a month, keep their deposit, return the first month's rent.
