Is the eviction process necessary in this case?
I'm looking to purchase a commercial multi-family property. It's been in foreclosure for a long time, and I was told that the previous owner has no information on leases or financials to provide. I don't believe any of the people currently living in the units have paid anything for a very long time. I don't have a way to determine who, if any, ever had a lease or is just a squatter. Is the normal eviction process still necessary? Or is it still easier to evict normally even if there are other options? I need everyone out as the place needs a ton of work. Thanks.

Basically with out a written lease they would be most likely be considered month to month tenants,, even if they haven't paid rent for a period of time.
Start with landlord tenant laws for your state and find out eviction process.
Ask for list of tenants from agent it's worth a try. Day you take over.. I'd give:
1. Give notice where and when rent is due and must be paid by 1st to each tenant.
2. I'd give non-renewal notice, the day you take possession with proper notice period so basically your looking at prior to the 1st of the month and a 30 day wait. State you would be able to accept a earlier vacate date.. You could offer cash for keys if vacated by the 20th..
3. If you don't receive rent by 3rd, pay or quit, file on the 5th for eviction.
4. Make sure your info is posted inside building for contact information.
Get your rental license for the property in your name.
You don't need to state a reason for non-renewal.
Good luck could take awhile to get them all out..
