Roommates one asks police to arrest the other who goes?

Question

Three roommates, students, dispute happens, police called, the word I get  is that they attacked each other but only one gets arrested because the other is pressing charges against her. Would you kick out one, the other, or all? Don't know if there is any protective order.   I told them you have a lease, this is not ok,  give me your plan to settle the dispute (e.g. someone moves out/is replaced or ???). I am just looking for experiences.  I don't generally mediate these things between tenants  but my student tenants haven't had this issue before. I don't yet have tenant responses at this point.

@Deanna McCormick  noise there is an ordinance where there is a citation and notification to us. I am not planning on doing anything unless they propose a change of roommates which would not be a problem with an acceptable candidate.   With an arrest I guess they'd say yes

Agree with most of what's been said already. If you want them gone however, we have a clause in our lease that states a preponderance of the evidence by us as the landlord is enough reason to start a 5 or 7 day notice and/or eviction if we wanted. In this case I'd just let them settle it until you don't get rent next month.

If the police hadn't been called I agree but since they were I let the tenants know that a pattern of police calls wouldn't be tolerated.  I told them they need to let me know  if there are changes they want to propose to settle the dispute one wants to leave but its a joint lease so they need to figure it out.

I made sure I had a good relationship with the sheriffs dept when I started, they send me runs reports in my community so I know what is going on, if this occurred in my community the sheriff would come in and speak to me about it giving me a run down of what happened, if you have a relationship with the officer as I do he will even give me the report. I agree to give it a couple days for cooling off and call all three in to speak to them, see if you can handle it that way , if it cant be resolved the lease holders will unfortunately receive a 30 day notice to move.

I bet she said to the judge.

"But I live there I have a lease"

and he said "You don't live there anymore darlin"

So she thinks she is "out of the lease" which I would guess is far from the case. Her parents are on it as well right? I would guess the judge didn't remove them from responsibility. If she never told them letting her know you will be working with them to satisfy the debt she still owes may get some response.

I have been sitting tight and I just got notification that one tenant has a no contact order and saying she is out of the lease because of it. She says judge told her. She is not living there and there and the other two are silent. I don't know if she got her stuff.  What experience have other people had with that? Kick them all out?  Wait and see when the rent is due?

Domestic,  Unless police were called also for noise or other issues were uncovered when they responded for complaint,   you do nothing.

If you have a liaison officer that is responsible to service your neighborhood I'l call and find out from police department who it is and get acquainted.   Otherwise if you call about a report make sure you let the police department know your the "PROPEPTYOWNER" and you want to verify no illegal activity was cause of response, they will usually tell you if it's just a domestic.

Now "Domestic issues" can become violent.. and when to get more involved usually is when NOISE level from yelling, or property damage has occurs so you can write up a lease violation and proceed from there.
