My Tenants have complained of Mold and trying to sue me

Hello BiggPocket members,

I have  2 bedroom rental in South Florida that rents for $850.month to an Old lady.

See called me last week complaining about a mold smell in the property.

I dispatched a Handyman that came back and said there was no mold . Smell was from Old carpets and the living conditions. 

I sent my AC guys and they said that the AC did not have any mold inside but it was low of freon and Unit had been hot the last few days. The filter was not the right size and could be causing the odor.

Today I got a call from the daughter and she says that her Mom has been sick because of Mold and they got an inspection done . The lady has also gone to a doctor (don't know the reports) but all this smells like a law suit to mild some money.

I spoke to the Mold inspector she used and he says there is Mold under the sink and in the AC closet. I have never been told of this issue and have a lease that says the Tenants refused Rental coverage and are responsible for any injuries or health.

I have offered her to move out and return all her deposits with no penalties. 

Lady does not want to move and insists that I tear down the kitchen and the AC closet. She has not said that she wants the medical payments but I have a feeling thats coming next.

How do I protect myself ?

Feeling very depressed and completely being taken advantage off.

When tenants cross the line and use the "m" word, you send a notice that they move out effective immediately no harm no foul to protect themselves.  If they don't move out immediately, they are well aware that it is at there own risk and must sign a hold harmless agreement.  If they do not sign a hold harmless, you give them another notice to vacate and then start the eviction process. Do not get sucked in to any games.
